These Terms & Conditions (“Terms”) govern your access to and use of the website thedeltastate.com (the “Site”) and your purchase of any delta[state]™ products from us. The Site and the delta[state]™ brand are owned and operated by NORTHSTAR WELLNESS SCIENCES PVT. LTD. (“delta[state]™”, “we”, “us”, or “our”). By accessing the Site, placing an order, or otherwise using our services, you (“you”, “your”, or “customer”) agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

1. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872, to place an order. By placing an order you confirm that the information you provide is accurate and that you are purchasing for personal, non-commercial use unless otherwise agreed in writing by us.

2. Products, dietary supplements & health disclaimer

Our products are dietary supplements intended to support sleep and recovery. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information on the Site is provided for general educational purposes and is not a substitute for professional medical advice.

Please read the label and directions before use. Consult a qualified healthcare professional before using any product if you are pregnant, nursing, taking prescription medication, have a known medical condition, or intend to give the product to a minor. Discontinue use and seek medical advice if you experience any adverse reaction. Individual results may vary.

3. Product information, pricing & availability

We take care to describe our products, ingredients, and prices accurately. However, product images are for illustration and packaging or formulation may be updated from time to time. All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Shipping charges, if any, are shown at checkout before you confirm your order.

We reserve the right to correct errors, update prices, and modify or discontinue products at any time without prior notice. In the rare event that a product is listed at an incorrect price or with incorrect information due to a technical or typographical error, we may cancel the order and refund any amount already paid.

4. Orders & acceptance

Your order is an offer to purchase. All orders are subject to acceptance and product availability. We will send an order confirmation once your order is received; this confirms receipt, not acceptance. A binding contract is formed only when we dispatch the product to you. We reserve the right, at our sole discretion, to refuse or cancel any order — including where we suspect fraud, pricing errors, stock unavailability, or a breach of these Terms.

5. Payments

We accept the following payment methods: UPI, credit cards, debit cards, net banking, mobile wallets, and Cash on Delivery (COD), subject to availability at checkout. Online payments are processed through third-party payment gateways, and your payment information is handled in accordance with their security standards. We do not store your full card details on our servers.

If an amount is debited from your account but you do not receive an order confirmation from us, please contact our customer support team at support@thedeltastate.com or +91 8448954548 with the following details so we can investigate: your transaction reference / UPI ID, registered email address and contact number, the product details of your order, and the amount debited. Payments that are not captured against a confirmed order are typically auto-reversed by the payment provider within 5–7 business days.

6. Shipping & delivery

Orders are ordinarily dispatched within 3–4 business days of order confirmation, subject to stock availability and successful payment (or COD verification). Delivery timelines thereafter depend on our courier partners and your location. Estimated delivery dates are indicative and not guaranteed. Risk of loss passes to you upon delivery to the address you provide.

Please ensure your shipping address and contact details are complete and accurate. We are not responsible for delays or failed deliveries caused by incorrect address information, the recipient being unavailable, or reasons beyond our reasonable control. Please refer to our Refund, Return & Cancellation Policy for what to do if a shipment arrives damaged or tampered.

7. Cancellations, returns & refunds

Cancellations, returns, and refunds are governed by our separate Refund, Return & Cancellation Policy, which forms part of these Terms. Please review it before placing an order.

8. Promotions, vouchers & discounts

Discount codes, vouchers, and promotional offers are subject to their own terms, are valid for the stated period only, cannot be combined unless expressly permitted, have no cash value, and are intended for one-time use per customer unless stated otherwise. We reserve the right to withdraw or modify any offer at any time. Where an order paid for using a single-use voucher is cancelled, the voucher is treated as used.

9. Intellectual property

All content on the Site — including the delta[state]™ name and logo, text, graphics, product designs, images, and layout — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, republish, distribute, or create derivative works from any part of the Site without our prior written consent. Nothing on the Site grants you any licence or right to use any trademark without our permission.

10. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to attempt unauthorised access to any system or data, to submit false or misleading information, or to infringe the rights of others. We may suspend or terminate access to the Site or refuse service to anyone who breaches these Terms.

11. User content & reviews

If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content in connection with our business. You are responsible for the content you submit and must ensure it is accurate, lawful, and not offensive or misleading. We may remove any content at our discretion.

12. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with any product or your use of the Site shall not exceed the amount you paid for the product giving rise to the claim. We shall not be liable for any indirect, incidental, special, or consequential loss. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence.

13. Indemnity

You agree to indemnify and hold harmless NORTHSTAR WELLNESS SCIENCES PVT. LTD. and its directors, officers, and employees from any claims, damages, or expenses arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

14. Force majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including acts of God, natural disasters, epidemics, strikes, courier or logistics failures, government restrictions, or failures of telecommunications or payment networks.

15. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time you place an order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

16. Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to any applicable consumer-protection rights, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
